Dr. Clara Herz’s dissertation was awarded the doctoral prize of the Munich Bar Association
Last year, Dr. Clara Herz’s dissertation “Die konkrete Normenkontrolle in Strafsachen” was published by us. The work has now been awarded the doctoral prize of the Munich Bar Association. Previously, the thesis had already been awarded a doctoral prize by the Friends and Sponsors of Law at the University of Passau.
In order to have the constitutionality of criminal norms or individual criminal procedural regulations clarified in a binding manner, the criminal courts can – and, if necessary, must – turn to the Federal Constitutional Court by way of a judicial referral pursuant to Article 100 (1) of the German Constitution. The award-winning study not only illustrates typical constellations in criminal law and criminal procedure, but also sheds light on the numerous legal problems posed by the procedure of concrete norm control in criminal cases. Criticisms of the current version and practice of Article 100 (1) of the Basic Law are finally brought together in a reform proposal.
